These Terms of Use (the “Terms”) are intended to define the terms and conditions governing the creation, use and deletion of the Customer Account on the CF Montréal website.

  1. Purpose and Acceptance of the Terms.
    1. Access to, creation and use of the customer account and the CF Montréal member portal (collectively, the “Customer Account”) are subject to the user’s unconditional acceptance of these Terms.
    1. By creating an account or using the Customer Account, the user acknowledges having read these Terms and expressly accepts them.
    1. CF Montréal reserves the right to modify these Terms at any time. Users will be informed of any material changes by any appropriate means (email sent to the address registered to the Customer Account or notification on the website).
  1. Eligibility. To create an account, the user must
    1. be an individual who is at least eighteen (18) years of age, or a duly constituted legal entity acting through an authorized representative;
    1. provide accurate, complete and up-to-date information at the time of registration;
    1. have a valid and active email address that belongs to the user; and
    1. not have previously had an account suspended or terminated by CF Montréal, unless prior written authorization has been provided by CF Montréal.
  1. Required information. When creating an account, the user is required to provide, at a minimum, the following information:
    1. the user’s first and last name (or legal name, in the case of a legal entity);
    1. the user’s complete mailing address;
    1. the user’s email address;
    1. a valid telephone number;
    1. a secure password, selected by the Account Holder in accordance with the security criteria set out on the Platform; and
    1. any other information identified as mandatory on the Platform’s registration form.

The user agrees to update the user’s information as soon as possible in the event of any change, by accessing the “My Profile” section of the Customer Account.

  1. Single account. Each user may hold only one (1) active account on the CF Montréal website. The creation of multiple accounts by the same user is strictly prohibited and constitutes grounds for the immediate suspension or termination of all accounts concerned, without notice and without reimbursement of any amounts paid in connection with any season ticket membership that the user may hold, if applicable.
  1. Login credentials and security. The user is solely responsible for maintaining the confidentiality of its login credentials (email address and password). The user agrees to:
    1. not disclose the its login credentials to third parties;
    1. not authorize a third party to access its Customer Account on the user’s behalf, except in the cases expressly provided for in these Terms; and
    1. notify CF Montréal without delay, at membres@cfmontreal.com, of any unauthorized use of the user’s account or any security breach of which the user becomes aware.

Neither CF Montréal nor the web service provider that powers the Customer Account may be held liable for any loss or damage resulting from the user’s failure to comply with the obligations set out in this section.

  1. Account verification and validation. CF Montréal and the web provider reserve the right to verify the information provided when the account is created, including by sending a confirmation email to the address provided. The account is considered active and valid only once the user has confirmed the email address. CF Montréal may, at any time and in its sole discretion, ask the user to provide additional supporting documentation to confirm the user’s identity or eligibility.
  1. Consent. By creating an account, the user expressly authorizes CF Montréal to send the user, on a technological medium and to the email address associated with the Customer Account, a copy of any ticket purchase agreement, season ticket membership agreement or agreement for other products or services, as well as a copy of any related documents.
  1. Link between the account and the Membership. A season ticket membership purchased by the user is linked exclusively and non-transferably to the Customer Account. As such:
    1. season tickets generated under the membership are accessible only through the user’s Customer Account;
    1. no ticket may be issued, printed, transferred or used without first logging in to the user’s Customer Account;
    1. the transfer of the account to a third party is prohibited and results in the nullity of the membership attached to it, without reimbursement.
  1. Account suspension and termination. CF Montréal reserves the right to suspend, terminate or delete the user’s Customer Account, with or without notice depending on the seriousness of the circumstances, in the following cases:
    1. provision of inaccurate, incomplete or fraudulent information;
    1. violation of the single-account clause set out in section 5;
    1. use of the account for unlawful purposes or purposes contrary to these Terms;
    1. non-payment; or
    1. any other breach of a contractual commitment by the user to CF Montréal.
  1. Account deletion and closure. The user may close the user’s account at any time by sending a request by email to customer service at membres@cfmontreal.com or directly from the “My Account” section of the Customer Account.
  1. Account inactivity. An account that has not been logged into for a period of twenty-four (24) consecutive months may be deactivated by CF Montréal after written notice is sent to the user at the email address associated with the account, granting a period of thirty (30) days to reactivate the account. If the user does not respond within that period, the account may be permanently closed and the associated data deleted in accordance with CF Montréal’s privacy policy.
  1. Protection of personal information. Personal information collected in connection with the creation and management of the user’s account is processed in accordance with CF Montréal’s privacy policy, available at https://en.cfmontreal.com/legal/privacy\_policy, and applicable personal information protection laws.
